Terms of use and sale
Version 1.0 — effective 23 October 2026
This English version is provided for convenience. In the event of any discrepancy, the French version prevails.
1. Purpose
These terms (the “Terms”) govern access to and use of the Like a Jester service (the “Service”), a platform allowing an organisation's employees to ask their management questions anonymously and to discuss them with it, through an independent trusted third party. They also set out the conditions for subscribing to paid plans. Any use of the Service implies full acceptance of these Terms.
2. Publisher
The Service is published by Pajar, a non-profit association governed by the French law of 1 July 1901, whose registered office is at -, registered under number - (the “Publisher”). Contact: contact@likeajester.com.
The Publisher is independent of client organisations: it is neither mandated nor controlled by them, and reports to them no information that could identify the authors of questions.
3. Definitions
- Organisation: the company, public body or association to which Users belong, identified by the domain name of their work email address.
- User: any person with an account on the Service.
- Employee: a User who can ask questions and add follow-up messages.
- Manager: a User authorised, by invitation, to read all of their Organisation's questions and reply on behalf of management.
- Customer: the Organisation subscribing to a paid plan, represented by a Manager.
- Reply: any message published by a Manager in a discussion thread.
4. Access and sign-up
Sign-up is exclusively through delegated authentication (“SSO”) with Google, using a work account (Google Workspace). Personal accounts and consumer email addresses (Gmail, Outlook.com, Yahoo…) are not accepted. On first sign-in, the User is attached to the Organisation matching the domain of their email address; if it does not yet exist on the Service, it is created automatically.
The User warrants that they use an account of which they are the legitimate holder. Use of the Service by Employees is free of charge.
5. Roles and invitations
The Manager role is granted by an invitation sent to an address belonging to the Organisation's domain: by an Employee when the Organisation has no Manager yet, then by the Managers themselves. The invitation never mentions the identity of the person who sent it. Managers may remove the role from another Manager; the Organisation must always keep at least one. A Manager cannot ask anonymous questions.
The Organisation is responsible for ensuring that the people holding the Manager role are authorised to speak on its behalf. The Publisher does not verify positions held within the Organisation.
6. Anonymity and confidentiality
6.1 Publisher's commitments
The Publisher undertakes to:
- never disclose to the Organisation, its Managers or any third party the identity of the author of a question, message or support (▲), nor any information from which it could be inferred, except under a binding legal obligation;
- design and maintain the Service so that no direct link between a question and a user account is stored, and so that the content of conversations is encrypted (see Anonymity & security);
- make no attempt to re-identify authors;
- not use the content of conversations for any purpose other than providing the Service, in particular for no commercial or advertising purpose;
- bind anyone working on the Service on its behalf to a confidentiality obligation.
If it receives a request from a judicial authority, the Publisher will verify its lawfulness, respond only to the strict extent required by law and, where the law allows, inform the User concerned.
6.2 Commitments of the Organisation and its Managers
The Organisation and its Managers shall not:
- attempt in any way to identify the author of a question or message (style analysis, cross-checking with sign-in logs, pressure on employees, requests to the Publisher…);
- take any retaliatory measure, sanction or discrimination linked to an employee's actual or presumed participation in the Service;
- force an employee to use or not to use the Service.
Any breach of this article entitles the Publisher to suspend or terminate the Organisation's access without notice, without prejudice to damages. The Service is not a whistleblowing reporting channel within the meaning of French law no. 2016-1691 of 9 December 2016 (“Sapin II”) or Directive (EU) 2019/1937, and does not replace employee representative bodies.
The Organisation is encouraged to inform its employee representative bodies that the Service is available.
6.3 Limits
Users are informed that anonymity also depends on the content they publish, on the size of their Organisation, and on the fact that the Organisation's IT administrators may know, through SSO, that an account has been created on the Service. The Publisher cannot be held liable for an identification resulting from content published by the User themselves.
7. Posting rules
Users undertake to publish respectful content in good faith. In particular, insulting, defamatory, discriminatory, harassing or threatening remarks are prohibited, as is content infringing the privacy of a third party (especially naming a colleague) or disclosing information protected by a legal secret.
Managers may hide from other Employees a public question with inappropriate content; it remains visible to its author and to Managers. The Publisher may remove any manifestly unlawful content reported to contact@likeajester.com.
8. Prices
The Service is free for any Organisation with no more than 10 active Users. Beyond that threshold, the Customer pays, per calendar month:
| Item | Monthly price |
|---|---|
| Per active Employee | €0.50 |
| Per Manager (“management” profile) | €10.00 |
A User is active for a given month if their account was active at any point during that month. Deactivated accounts are no longer counted from the month following their deactivation. A User who held the Manager role at any point during the month is billed as a Manager for that month. If the total number of Users active during the month does not exceed 10, nothing is billed.
No payment method is required to use the Service under the free threshold. When an Organisation exceeds 10 active Users without a valid payment method, or after a failed payment, questions and replies are paused: they remain visible but no new question, message or support can be posted until a payment method is registered or the number of active Users falls back under the threshold. No data is deleted.
Prices are in euros. [VAT regime to be specified: e.g. “VAT not applicable, article 293 B of the French Tax Code” if the association benefits from the VAT franchise, or prices excluding VAT plus VAT at the applicable rate.] The Publisher may change its prices; any change is notified to the Customer at least thirty (30) days before it applies and gives a right to terminate at no cost.
9. Billing and payment
A payment method is registered by a Manager, who represents that they have authority to bind the Organisation. Payment is made by card or direct debit through the payment provider Stripe; the Publisher never has access to the Customer's full payment details.
Billing is monthly and in arrears: at the end of each calendar month, an invoice is issued on the basis of all Users active during the month and charged automatically to the registered payment method. Invoices are available in the “Billing” area. If a payment fails, the Customer is notified and conversations may be paused until the situation is regularised.
As the Service is intended exclusively for professionals acting on behalf of their Organisation, the consumer right of withdrawal does not apply.
10. Deactivation, termination and deletion
Managers may deactivate any User of their Organisation (in particular those who have left it). A deactivated User can no longer sign in and is no longer billed from the following month; the questions, messages and replies already published remain in the history. A deactivated account can be reactivated at any time. Managers cannot delete a User's account.
The Customer may remove its payment method at any time from the “Billing” area; the month in progress remains due. Each User may delete their own account at any time from the “Account” page, in accordance with their right to erasure. An Organisation may request complete deletion of its space by writing to the Publisher; its questions and conversations are then permanently erased.
The Publisher may suspend or terminate a User's or Organisation's access in the event of a serious breach of these Terms, after formal notice that has remained unheeded for fifteen (15) days, or immediately in the event of a breach of article 6.2 or manifestly unlawful content.
11. Personal data
The Publisher acts as data controller for Users' data, independently of the Organisation: this is the condition of its position as a trusted third party. Through its Managers, the Organisation only receives the content of questions, stripped of any data identifying their authors. Details of processing, retention periods and individuals' rights are set out in the privacy policy.
12. Security and availability
The Publisher implements appropriate technical and organisational measures to protect data: encryption of communications (HTTPS) and content, key separation, backups, security updates and strict access control. It strives to ensure continuous access to the Service, without any obligation of result; interruptions may occur for maintenance. Any personal data breach likely to result in a risk to individuals will be notified in accordance with articles 33 and 34 of the GDPR.
13. Liability
The Publisher is bound by an obligation of means. It is not responsible for content published by Users, for which it acts only as a host within the meaning of article 6 of French law no. 2004-575 of 21 June 2004, nor for decisions taken by the Organisation on the basis of the conversations. Except in case of gross negligence or wilful misconduct, and excluding any breach of article 6.1, the Publisher's liability towards a Customer is limited to the amounts actually paid by that Customer over the previous twelve (12) months.
14. Intellectual property
The Service, its code, brand and editorial content are the property of the Publisher. Users retain their rights to the content they publish and grant the Publisher a non-exclusive, royalty-free licence, limited to what is necessary to provide the Service, for as long as it is published.
15. Changes to these Terms
The Publisher may update these Terms. Users will be informed of any substantial change at least thirty (30) days before it takes effect. Continued use of the Service after that date constitutes acceptance.
16. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before taking any action. Failing that, and for disputes between professionals, exclusive jurisdiction is granted to the courts within the jurisdiction of the Paris Court of Appeal.
